इसका ताजा उदाहरण उन्होंने 11 जुलाई को विभाग को देखने को मिला। सहायक आयुक्त अर्निका यादव और निरीक्षक लाल बाबू पांडेय से लॉग बुक भरने को लेकर कहा सुनी हो गई। सहायक आयुक्त अर्निका यादव ने संबंधों के बल पर पुलिसया गुंडों को बुला लिया। बिना किसी लिखित शिकायत के पुलिसया गुंडे निरीक्षक लाल बाबू पांडेय को गरियाते हुए थाने ले गये। पुलिसिया गुंडों ने इन्हें लगभग 12 घंटे तक थाने में बंधक बनाये रखा। जहां निरीक्षक लाल बाबू पांडेय को पुलिसिया गुंडों ने बांधकर मारापीटा और मुंह बंद रखने को कहा। झूठे केस में फसाने की धमकी भी दी। GST विभाग के उच्च अधिकारियों के हस्तक्षेप के बाद दूसरे दिन निरीक्षक लाल बाबू पांडेय को छुड़ाया जा सका। निरीक्षक वर्ग में इस घटना के बाद ख़ासा रोष है।
इस तरह अवैध रूप से एक केंद्रीय अधिकारी को बिना किसी भी लिखित शिकायत के कार्यालय समय में उठाना और बंधक बना के रख के प्रताडि़त करने से क़ानून व्यवस्था का खोखलापन और अधिकारियों का मनमानापन एक बार फिर से उजागर हो गया।
इस घटनाक्रम से मोदी सरकार के जीएसटी में लोक सेवा के दावों की पोल खुलती नज़र आती हैं क्यूँकि जब अपने ही विभाग के अधिकारियों को इस तरह अपने अहम के लिए प्रताडि़त किया जा सकता हैं तो फिर आम जनता की क्या बिसात?

सूत्रों से पता चता है कि कार्यालय के पैसों को ग़लत तरीक़े से अपने सुविधाओं के लिए ख़र्च करने और GST आने पर भी अपने निजी कार्यों कार्यालय आने जाने के लिए सरकारी वाहन का सहायक आयुक्तों द्वारा लगातार दुरुपयोग किया जा रहा हैं। इसी तरह डरा धमका के निरीक्षकों से फर्जी लॉग बुक कार के लिए भरवायी जाती हैं जिसका पूर्णतया निजी उपयोग होता हैं।
ज्ञात हो कि सहायक आयुक्त को केंद्रीय सरकार ने गाड़ी का प्रावधान नहीं किया हैं। सरकार को केवल एक सहायक आयुक्त के निजी उपयोग के लिए कार पर प्रतिमाह लगभग 30 हज़ार रूपया ख़र्च करना पड़ता हैं जबकि सहायक आयुक्त को कहीं भी आने-जाने के लिए लगभग 10 हजार रूपये भत्ता भी मिलता हैं। निरीक्षक वर्ग ने पुलिसियां गुंडों पर कार्रवाई की मांग की है।

From the letters of both lal babu pandey and AC Arnika Yadav one thing is proved beyound doubt that the police had illegally detained the inspector on the complaint of AC not yet confirmed whether writtin or verbal. One of the police officer as per insiders is also arelative of the lady officer. Action has already been taken against the inspector. When will justice see the light of the day. A fact finding team comprising of officers of all group should be sent to Barabanki to see ground realities both in office as well at thana level. They should submit a report to the higher officers and if need be the senior officers should seek a report from DGP whether any FiR has been filed and if the police has acted without bias. Then an enquiry committee consisting of officers from all groups be made and whoever is guilty must be punished, so that the departments image is not put to ransom. Comminsurate punishment for their misconduct to both in terms of conduct rules.
The true fact should definety be brought out by the department by establishing a independent committee and who is guilty must be punished. But the incident happened with the inspector is not correct. If he was wrong then the higher officer should take action as per departmental procededure. If his behaviour was not good then the same should be reflect in his APAR and vigilance action should also be initiated but if these have not been initiated then action taken by the Asst commr is not correct.

ये सूचित करना चाहती हूँ कि श्री लाल बाबू पांडेय निरीक्षक ने मेरे कार्यालय में ०३.०७.२०१८ को कार्यभार ग्रहण किया और शुरू से ही उनका व्यवहार बहुत ही असभ्य रहा । पहले ही दिन उन्होंने कहा कि आप तो नयी आयीं हैं , हम तो बहुत सालों से हैं । जब मैंने उनसे कहा कि कोई समस्या आए तो मुझे बतायें क्यूँकि वो नए नए कार्यालय में आए हैं , इसपर उन्होंने कहा ,”अभी आती है समस्या , तब बताते हैं “। उसके बाद जब उनका मन हुआ वो आए और चले जाते हैं और पूरे दिन मेज़ पर अपने हाथो से तबला बजाते रहते हैं । यदि मैं उनको कोई काम देती थी तो वो बहुत ग़ुस्सा हो जाते थे और मुझे देर तक घूरते रहते थे । दिनांक ०९.०७.२०१८ को जब मैंने पूछा कि आप क्या काम कर रहे हैं , उन्होंने बोला कि मेरे पास कोई काम नहीं हैं । इसके पश्चात मैंने उनको कार्य दिया । १०.०७.२०१८ की दोपहर को , मैंने इन्हें अपने कार्यालय कैबिन में बुलाया और कार्य के बारे में पूछा जिसे इन्होंने करने से मना कर दिया । जब मैंने जो काग़ज़ात माँगे थे लाने पर ज़ोर दिया तो ये मेरे कैबिन में घुसे और मेज़ पर मेरे तरफ़ आकर मेरे बिलकुल बग़ल में खड़े होकर काग़ज़ातों को मेज़ पर पटक दिया। उनको मना करने पर वो मेरे बग़ल में खड़े हो कर मुझे घूरने लगे जबकि मैं कुर्सी पर बैठी थी और उलटा सीधा बोलने लगे । उनको दूसरा अवसर देने के लिए मैंने श्री अमित कुमार , EA को बुलाया और मेरे सामने उनको कार्य समझाने को कहा लेकिन श्री पांडेय का रूख पूरी बातचीत के दौरान असहयोग वाला रहा । उनसे पूछने पर कि उन्होंने क्या समझा उन्होंने कोई जवाब नहीं दिया फिर कहा, “कुछ नहीं करूँगा जो करना है कर लो”। वो लगातार मुझको ग़लत और डरावने तरीक़े से घूरे जा रहे थे, जिससे मैं बहुत असहज महसूस कर रही थी । उनसे कहने पर कि मुझे घूरिए मत , वो फिर भी नहीं माने । उनसे पूछने पर कि आप क्या कर रहे हैं , वो मज़ाक़ उड़ाने के अन्दाज़ में बोले कि आपको देख रहा हूँ । उनसे ये बोलने पर कि मैं आपके व्यवहार की शिकायत आयुक्त महोदय से करूँगी , वो डराने वाले अन्दाज़ में बोले “हाँ बता दो देख लेंगे “। उन्होंने मुझे अगर वो मुझे नौकरी से निकाल सकती हैं तो निकाल के दिखा दे । उनका शारीरिक हाव भाव पूरे समय बहुत ही डरावना और आक्रामक रहा । अंतिम प्रयास के रूप में मैंने उनसे अपने attitude में सुधार लाने को कहा , इसपर उन्होंने कहा , “२ दिन हुए ऑफ़िस में आए, हमें चली सिखाने” और हाथ और चेहरे से अपमानजनक हाव भाव बनाने के बाद अचानक से बाहर निकल गए । इस घटना की एक छोटी रिपोर्ट आपके कार्यालय में मैंने १०.०७.२०१८ को ही जमा कर दी थी ।
ये भी ग़ौर करने की बात हैं कि जब ये गोरखपुर आयुक्तालय में तैनात थे तो इसी तरह के व्यवहार के लिए पिछली बार भी विभाग द्वारा suspend किए गए थे , और अभी हाल ही में वापिस आए हैं । इनका अधीक्षक के लिए विभागीय प्रोन्नति को भी रोक लिया गया हैं । ये क़रीब ३०० दिनो के लिए कार्यालय से फ़रार रहे है और प्रायः कानूनो का उल्लंघन करते हैं । ये हिंसात्मक व्यवहार में पहले भी सम्मिलित रहे हैं जैसे कि कार्यालय में काँच का ग्लास तोड़ना । ये अपने साथ काम करने वालों को भी लगातार प्रताड़ित करते हैं ।इनका APAR भी ख़राब है । निजी स्तर पर पूछताछ करने पर ye पता चला हैं कि गोरखपुर में dial १०० पर इनके ख़िलाफ़ अपने पत्नी को बुरी तरह मारने की शिकायत भी आयी थी , जो कि इनका महिलाओं के प्रति सामान्य अनादर दिखाता हैं । और भी बहुत कुछ इनकी फ़ाइल देख कर और उचित जाँच से इनके ख़िलाफ़ पाया जा सकता हैं ।
इनके पुराने कृत्य और मेरे लिए आक्रामक व्यहवार के कारण , इनकी कार्यालय में लगातार उपस्थिति मुझे असुरक्षा का अहसास करा रही थी। ये एक लोक अधिकारी के कार्य में बाधा उत्पन्न करने , बदतमीज़ी करने, डराने और बार बार घूर कर मेरी मॉडेस्टी का उल्लंघन करने के ज़िम्मेदार हैं ।
मैं बहुत ज़्यादा मानसिक प्रताड़ना से इनके कारण गुज़री। इसलिए मैंने ११,०७.२०१८ को पुलिस को लिखित शिकायत दी , चूँकि कार्यालय में अकेली महिला होने के कारण मुझे अपनी सुरक्षा सुनिश्चित करनी थी कि कहीं फिर या भविष्य में आगे मेरे साथ इसी तरह का या इससे भी ख़राब व्याहवहार इनके द्वारा ना किया जा सके । अगर ये करेंगे तो ये माना जाएगा कि इनके द्वारा किया गया व्याहवार पहले से सोच समझ कर मुझे चोट पहुँचाने के लिए किया गया हैं ना कि उस क्षण आवेश में आ कर । मैंने पुलिस और विभाग दोनो को सूचना दी और इसलिए निजी और प्रफ़ेशनल दोनो रास्ते जो बनते थे लिए । १२.०७.२०१८ को पुलिस द्वारा इनका लिखा हुआ माफ़ीनामा मुझे दिया गया जिसमें इन्होंने स्पष्ट रूप से अपने व्यवहार के लिए माफ़ी माँगी हैं और भविष्य में किसी भी कर्मचारी के साथ ऐसा व्यवहार ना करने के लिए कहा हैं । लेकिन इनके ऐटिटूड में कोई भी पछतावा नहीं दिखता ना ही मौखिक रूप से इन्होंने मुझसे माफ़ी माँगी ।
उपरोक्त घटनाक्रम के प्रकाश में , आपसे ये अनुरोध हैं कि श्री लाल बाबू पांडेय का स्थानांतरण तुरंत ही मेरे कार्यालय के बाहर किया जाए और और इनके ख़िलाफ़ इनके पूर्व में किए कृत्यों, मामले की गम्भीरता और कई उचित व्यवहार के नियमो के उल्लंघन को ध्यान में रखते हुए विभागीय कार्यवाही आरम्भ की जाए ।

Vineet kumar singh ji . लाख ग़लतियाँ रही हो लाल बाबू पांडेय की , वो बदतमीज़ भी रहा हो । लेकिन देश में क़ानून हैं कोर्ट हैं कचहरी हैं । जो जुर्म किया गया हो उसकी सज़ा दी जाए । अगर उसको ट्रान्स्फ़र , पोस्टिंग और suspension से डर नहीं भी हो तो भी जो उचित कार्यवाही होगी जुर्म के हिसाब वही तो की जा सकती हैं जैसे कि अभी माँग की गयी हैं महोदया द्वारा कि उनका ट्रान्स्फ़र करके उनपर कार्यवाही की जाए वो विकल्प उस समय भी था । लेकिन सबक़ सिखाने वाला attitude थोड़ा समझ से परे हैं जिसमें एक केंद्रीय कर्मचारी को पुलिस द्वारा उठा लिया जाए मारा पिटा जाए । इससे पूरे निरीक्षक कैडर का स्टेट पुलिस के सामने अपमान हुआ हैं ।
वैसे तो निरीक्षक को इस विभागमें दोयम दर्जे का बना के ग़ुलाम का दर्जा दिया गया हैं और विभागीय कोई भी संसाधन उनसे share नहीं किए जाते । सब कुछ आईआरएस पर ख़र्च होते हैं । डीजीएचआरडी के नोर्मस से ३-४ गुना जगह IRS ने अपने कैबिन की ली हैं और निरीक्षक को उसके नोर्मस का चौथाई भी नहीं लेने दिया । इतना अधिक अंतर आपको किस केंद्रीय विभागमें मिलेगा । ऊपर से जानबूझकर ऐसी रीस्ट्रक्चरिंग कि कोई भी निरीक्षक कभी प्रमोट ना हो ।
रही बात लॉग बुक वाली तो ठेकेदार को उतना ही देने की तकनीकी चक्करों में ना फँस के बस इतना पूछना चाहता हूँ कि क्या वास्तव में गाड़ी का इस्तेमाल कार्यालय के लिए होता हैं ? क्या IRS उसे निजी वाहन मान के उपयोग नहीं करता ? अगर आईआरएस २-३ दिन छुट्टी पर चला जाए तो वाहन का अटा पटा क्यूँ नहीं रहता ? अगर आपको निजी उपयोग रोकने को गम्भीर हैं और मानते हैं कि कार्यालय के कार्य के लिए इसका इस्तेमाल होना चाहिए तो एक पारदर्शी व्यवस्था वाहन के लिए क्यूँ नहीं बनायी जाती ?
आप को क्या लगता हैं जीएसटी के कार्य से कार कितनी चलती होगी एक महीने में ? जबकि कोई निरीक्षक को यदा कदा ही गाड़ी दी जाती होगी फिर चलाता कौन हैं और निजी रूप से चलाने का हक़ दिया किसने ?

अब इससे बुरा क्या हो सकता है, जब घर के बड़े, घर मे काम करने वाले के साथ दुराचार कर रहे हैं। और इनसे उम्मीद भी क्या की जा सकती है, जब एक बिभाग में 1 एग्जीक्यूटिव और 7 सुपरवाइजरी पोस्ट हो, पता नही ये सातो मिल के क्या सुपरवाइज़ करते हैं?? जो विभागीय गाड़ियां विभागीय इस्तेमाल के लिए होती है उन्हें ये घरेलू इस्तेमाल में लेते हैं और फिर गलत लॉग बुक इन बेचारों से जोर जबरदस्ती कर भरवाते हैं। और ऐसा न करने पर इंडिससिप्लिन की धमकी देते हैं। खैर अब GST से उम्मीद है, जब इन IRS अधिकारियों के बाप IAS अधिकारी होंगे। ईश्वर से दुआ है कि इन्हें IAS से वही बर्ताब मील जो ये अपने अधीनस्थों से करते हैं।

आज-कल वैसे भी सरकारी गाड़ियां नहीं बची जिनमें की लॉग बुक भरने की अनिवार्यता हो सभी गाड़ियां किराए पर लगाई जाती हैं और किलोमीटर तथा ड्यूटी के दिन तय होते हैं चाहे 10 किलोमीटर चले या 25 किलोमीटर जितना महीने का ठेका है उतना देना होगा इसलिए लॉग बुक वगैरा की बातें करना बेमानी है और सबसे बड़ी बात कि लाग बुक भरना ड्राइवर का काम होता है। यदि किलोमीटर ज्यादा हो जाते हैं तो उसको वेरीफाई करने के लिए एक रजिस्टर रखा जाता है वैसे भी आमतौर पर यदा कदा ही किलोमीटर की सीमा से अधिक गाड़ियां चलती है क्योंकि हर महीने के बचे हुए किलोमीटर कैरी फॉरवर्ड हो जाते हैं और प्राइवेट सप्लायर आए दिन गाड़ियां बदलते रहते हैं और तथा ड्राइवर भी बदलते रहते हैं इसलिए यह सब बातें सिर्फ असिस्टेंट कमिश्नर के ऊपर गाड़ियों के व्यक्तिगत उपयोग का आरोप सिद्ध करने के प्रयास प्रतीत होते हैं। इस मुद्दे पर कोई चर्चा नहीं हो रही है कि लालबाबू पांडे ने ऐसी परिस्थिति क्यों पैदा की?

जब अपनी हालत पतली देख लालबाबू पांडे ने गलती स्वीकार कर ली तो फिर लिखित शिकायत का मामला ही नहीं बनता और रही बात कमिश्नर को बताने की तो ऐसा जरूरी नहीं है की हर मामला असिस्टेंट कमिश्नर अपने कमिश्नर को बताएं। असिस्टेंट कमिश्नर अपने आप में डिवीजन का हेड होता है और क्लास वन अधिकारियों को निर्णय लेने की स्वतंत्रता विधिपूर्वक दी गई है।
This shows the mentality of police in Uttar pradesh. Without any FIR or written complaint if they can illegally detain and harass an Central Government officer of the rank of inspector just to please their higherups then it is not hard to imagine their behaviour with common man.
Immediate action should be taken against such officers (suspension to begin with and followed by independent enquiry).

This news is nothing but only to defame the Assistant Commissioner who is strict against these type of employees. News should investigate the facts then should publish the article. This Inspector Lal Babu Pandey was posted at Gorakhpur where he also misbehaved with his assistant commissioner. After investigation he was suspended for 3 months.
